These Terms of Service ("Terms") govern your use of monikamarketingstudio.com and any marketing services provided by Marketing by Monika ("we," "us," "our"), based in Calgary, Alberta, Canada. By using the Site or booking a strategy call, you agree to these Terms.

1. Our Services

We provide digital marketing services, including Google Ads, Meta Ads, TikTok Ads, local SEO, landing page design, and lead-generation campaign management. The free strategy call is an introductory consultation and does not, by itself, create a paid engagement. A separate agreement (which may be a simple written or emailed scope of work) governs any paid engagement, including pricing, deliverables, and start date.

2. No Guarantee of Specific Results

Figures, calculators, and assessments on this Site (including the Customer Growth Calculator and Marketing Growth Score) are illustrative estimates for general information only. They are not a guarantee of leads, customers, revenue, or any other specific outcome. Advertising platform performance, market conditions, and your own offer and follow-up all affect actual results. Any guaranteed price, timeline, or specific result referenced in our marketing binds us only under a signed engagement agreement that says so explicitly — general marketing statements on this Site are not that offer.

3. Month-to-Month; No Long-Term Contract

Paid engagements are month-to-month unless a signed agreement states otherwise. Either party may cancel with the notice period stated in the applicable engagement agreement (typically 30 days), and cancellation does not entitle either party to a refund of amounts already spent on active ad campaigns.

4. Communications Consent

By submitting a form on this Site, you consent to be contacted by Marketing by Monika by phone, text, or email about your inquiry, consistent with Canada's Anti-Spam Legislation (CASL). 5. Your Responsibilities

Provide accurate, complete information about your business, including anything relevant to ad platform policies (e.g., licensing, regulated-industry restrictions).
Respond to requests for approvals, assets, or account access in a timely way — delays on your end can delay campaign launch or performance.
Use the Site lawfully and not attempt to disrupt or misuse it.

6. Advertising Platform Compliance

All campaigns are subject to the advertising policies of the relevant platform (Google, Meta, TikTok). We are not responsible for ad account suspensions, disapprovals, or policy changes made by these third-party platforms that are outside our control.

7. Intellectual Property

All content on this Site is owned by or licensed to Marketing by Monika and may not be copied or reused without permission. Ad creative, landing pages, and strategy documents produced for a client become that client's property upon full payment, unless the engagement agreement states otherwise.

8. Warranty Disclaimer

The Site and its content are provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law.

9. Limitation of Liability

To the fullest extent permitted by law, Marketing by Monika is not liable for any indirect, incidental, or consequential damages (including lost profits or lost business opportunities) arising from your use of the Site or our services. Our total liability for any claim is limited to the fees you paid us in the three months preceding the claim, or as otherwise set out in your engagement agreement.

10. Indemnification

You agree to indemnify and hold Marketing by Monika harmless from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the Site or our services.

11. Third-Party Links & Tools

The Site may link to or embed third-party tools (e.g., scheduling, analytics, ad platforms). We are not responsible for their content or practices.

12. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of Calgary, Alberta.
